Terms of Service
These terms apply to your use of ascendedscaling.com and to the social media marketing services Ascended Scaling provides. Using this site means you accept them. Specific work is governed by the written proposal or agreement we sign with you, which takes precedence over anything here if the two disagree.
Who we are
Ascended Scaling is a social media marketing agency operating from Nassau, New Providence, The Bahamas. We provide social media management, paid social advertising, content creation, audience growth strategy, influencer and user-generated content campaigns, website design, and reporting.
Enquiries and strategy calls
An enquiry or a booked strategy call is not a contract and costs you nothing. A booked call is a request for a time slot; we confirm it by email and we may need to move it, in which case we will tell you as soon as we can. Nothing is owed by either side until a proposal is signed.
No guarantee of specific results
Social media and advertising results depend on your market, your offer, your pricing, your budget, the quality of what you sell and the behaviour of platforms we do not control. Any figures on this site — follower growth, impressions, return on ad spend, bookings — describe past work or examples and are not a promise of what you will achieve. We do not guarantee any particular ranking, reach, follower count, lead volume, conversion rate or revenue.
Advertising spend
Our fees are for our work. Money paid to Meta, TikTok, Google or any other platform for advertising is separate and is yours. Where you ask us to run spend through our own accounts, it is billed to you at cost and is payable in advance.
Your responsibilities
- give us accurate information, and timely access to the accounts and assets we need;
- review and approve content and campaigns when we ask;
- make sure anything you give us — logos, photographs, video, music, testimonials, claims about your products — is yours to use or properly licensed;
- comply with the advertising rules of the platforms, and with the law that applies to your business;
- pay invoices by their due date.
We may pause work on an account with an overdue invoice, and we are not responsible for results lost while work is paused.
Platform decisions
Meta, TikTok, Instagram, Google and other platforms can reject an advert, restrict an account or change their rules and algorithms at any time, without notice and without explanation. We will do what we reasonably can to resolve it, but we are not liable for a platform’s decisions.
Intellectual property
This website, its design, copy and code belong to Ascended Scaling. Content we create for you becomes yours on full payment for the work it belongs to; until then we retain it. We keep ownership of our own templates, processes, internal tools and know-how. Unless you ask us in writing not to, we may show work we have produced for you in our portfolio and case studies.
Confidentiality
We keep what you tell us about your business confidential and use it only to do the work, except where the law requires disclosure.
Limitation of liability
To the fullest extent the law allows, our total liability for any claim arising out of our services is limited to the fees you paid us for the three months before the claim arose. We are not liable for indirect or consequential loss, including lost profit, lost revenue, lost data or loss of goodwill. Nothing in these terms excludes liability that cannot lawfully be excluded.
Termination
Either side may end an ongoing engagement with 30 days’ written notice unless the signed proposal says otherwise. Fees for work already done, and advertising spend already committed, remain payable. We may end an engagement immediately if we are asked to do something unlawful, deceptive or against a platform’s rules.
This website
We try to keep the site accurate and available but do not promise it will be uninterrupted or error-free. Links to other sites are for convenience; we are not responsible for what is on them.
Privacy
What we do with the information you send through this site is set out in our Privacy Policy.
Changes
We may update these terms; the date at the top shows when they last changed. Continuing to use the site means you accept the current version.
Governing law
These terms are governed by the laws of the Commonwealth of The Bahamas, and the courts of The Bahamas have exclusive jurisdiction over any dispute.
